JIME VS APC: HON MOVES TO SUPREME COURT


Lead Counsel to the Benue State Governor-elect, Chief Dr Samuel Ortom, and the All Progressives Congress, APC, Sebastian Hon, a Senior Advocate of Nigeria, SAN, has disclosed that he would challenge the Appeal Court's decision today to strike out his appeal against the ruling of an Abuja Federal High Court at the Supreme Court.
He had appealed the ruling of the Abuja Court Presided over by Justice Evoh Chukwu which granted the motion brought before it by Rt. Hon Emmanuel Jime, and Senator JKN Waku to discontinue proceedings against Senator George Akume and Comrade Abba Yaro, in the case they instituted challenging the nomination of Chief Dr Ortom as governorship candidate. 


According to the Senior Advocate of Nigeria, although the Appeal Court's decision did not affect the substance of the case he felt strongly that the court erred hence he would seek redress at the highest court in the land.
Still Hon said there was no cause for alarm.
When the case came up in court about two weeks ago the plaintiffs' lawyer, Sunday Ameh, also a Senior Advocate of Nigeria, SAN, told the court that his clients wished to settle the matter out of court and promised to report back to the court on April 30, 2015.
His request was granted.
On the eve of the Governorship and House of Assembly elections on April 11th, there was an announcement on Harvest FM Makurdi that Rt Hon Jime and Senator Waku had withdrawn the case following the intervention of the President-elect, General Muhammadu Buhari.
Before this the case witnessed dramatic twists as two plaintiffs, Chief Akange Audu, and Chief Mike Iordye declared in court that their signatures had been forged in the document which purported that they had adopted Rt Hon Jime as the consensus candidate.
Chief Iordye also requested the Court's permission to withdraw from the case and was obliged while Chief Audu asked to be joined as a party which was also granted.
One of the plaintiffs, Professor Steve Ugbah became the Director General of the Ortom/Abounu Governorship Campaign Organization and successfully prosecuted the campaign.
Close observers also note that if the case persisted Rt. Hon Jime may be prosecuted for forgery of the signatures of Chiefs Audu and Iordye attributing the delay in his prosecution for the criminal acts to Chief Dr Ortom’s magnanimity.
